AGREEMENT READ CAREFULLY BEFORE SIGNING.

Promise to Pay:   You promise to pay us, in accordance with the payment schedule.  If you pay late you will be charged a $25 late fee.  If at any time your account is unpaid any due amount, you may be considered in default.

No change in terms:  Only a duly executed written amendment to this agreement constitutes  a change to this agreement.

Prepayment: You have the right to prepay your loan in whole or in part at any time. If you prepay your loan, you will not have to pay a penalty. You will not be entitled to a refund of any portion of your interest for the period in which you are currently in.

Rescission: you may cancel this loan without paying any interest. In order to do so, you must pay us the total amount that we have given you under this agreement with certified funds no later than the close of business on the first business day following the date of this agreement.  Your payment must be in the form of cash, approved money order or cashier’s check.

Nonpayment and Default: we may declare you to be in default of this agreement if you fail to make any scheduled payment on time and in full. You will not be in default, and will instead have the benefit of a grace period provided by us, unless and until we give you a written notice of default. Any notice of default will explain the nature of your default and any right to a repayment plan pursuant to NRS 604A.475. Upon default and subject to applicable law (including any right you may have to enter into a repayment plan), we may: (A) exercise all of our rights under applicable law; and (B) recover any collection costs and legal fees authorized under NRS 604A.415.

Phone Calls – Email – SMS/Text: You agree that if you are past due or are in default, you will accept calls from us regarding the collection of your loan. You understand that these calls might include a voice message. You agree that we may contact you via email to any email address you provide us regarding your account. In addition, you consent that we may transmit SMS/text messages to any wireless telephone number you provide us regarding your account. These SMS/text messages to your device regarding your account may result in charges from your wireless carrier. Those charges will not be reimbursed to you. If you wish to opt-out from either email or SMS/text messages, please contact us at the phone number provided above.

Bankruptcy: You represent that you are not currently a debtor in any bankruptcy proceeding and that you have no intention of filing bankruptcy under any chapter of the US bankruptcy code during the term of the loan or within 90 days after your final payment. Any notices of future bankruptcy petition and all communication concerning a bankruptcy with our office, identified above, is null and void and has no effect.

Credit Reporting: You agree that we may make inquiries concerning your credit history and standing, and we may report information concerning your performance under this agreement to credit reporting agencies. Late payments, missed payments or other defaults on your account may be reflected in your credit report.

Active Military: By signing this you state that you are not a member of the armed forces on active duty (or its dependent).

Privacy: It is Superior Mint’s responsibility to protect our customer’s non-public and personal information from disclosure to any unauthorized parties.  Superior Mint may collect non-public personal information about you from the following sources: information we receive from applications or other forms; information about your transactions with us, our affiliates, or others; information we receive from a consumer reporting agency.  We do not disclose any non-public personal information about our customers or former customers to anyone except to our affiliates and non-affiliated third parties as required by law. We restrict access to non-public personal information about you to those employees who need to know that information as well as our affiliates and non-affiliated third parties working on our behalf to provide products and services to you, to administer your account or to collect any money or collateral due to us.
